Summary:

You do not need an Account to place orders at tylko.com. In such cases, you may use the Service upon acceptance of these Terms. Should you choose to register, we will create an Account for you in accordance with these Terms. To do so, you must accept the Terms, provide us with your personal data, and consent to its processing under the conditions set out in the Privacy Policy.

2.1. An Account may only be maintained following the conclusion of a service agreement between Tylko and the User (the "Agreement"). The Agreement is formed upon the User's registration within the Service, or by logging in via any authentication method made available within the Service (e.g. email address and password, or login via third-party authentication services — "Registration"). Upon completion of Registration, the User will receive a confirmation email at the address provided during Registration, confirming that the Agreement has been entered into.

2.2. The User undertakes to provide only accurate and truthful information during Registration.

2.3. The personal data required from the User in order to enter into the Agreement are clearly marked within the registration form ("Basic Data"), namely: (a) full name; (b) email address; (c) residential address; (d) telephone number.

2.4. Registration shall be ineffective if, during the Registration process, the User: (a) refuses to accept the Terms; (b) refuses to provide the Basic Data; or (c) provides incomplete or inaccurate data.

2.5. By ticking the appropriate box during Registration, the User acknowledges that the controller of their personal data is Tylko S.A., with its registered office in Warsaw at ul. Czerska 8/10 (the "Controller"). Personal data is processed in accordance with the Privacy Policy available at: https://tylko.com/en-uk/privacy_policy/the-basis-and-purpose-of-personal-data-processing. The User may contact the Controller on all matters relating to the processing of personal data and the exercise of data subject rights by emailing: [email protected].

2.6. The Agreement is concluded for an indefinite period and may be terminated by either the User or Tylko in accordance with the provisions of Section 9.

2.7. By ticking the appropriate box during Registration, the User requests that the provision of Services commence prior to the expiry of the withdrawal period referred to in Section 9.1. In such circumstances, should you choose to exercise your right of withdrawal from the Agreement, you will be obliged to pay for the Services provided by us up to the moment of withdrawal, on a pro-rata basis proportional to their scope and duration, in accordance with Article 35 of the Consumer Rights Act. Given that the Services (Account management) are provided free of charge, this amount will, in practice, be nil.
