Summary:
You place an order after going through the configuration process and by clicking the "pay securely now" button. If you have an account, you won’t need to provide your personal data again. All payments and deliveries are processed by third party providers. Note that we will not process your order before we receive payment confirmation. Also, due to the fact that all our products are custom made, you will not be able to cancel or change your order. You may, however, return your Product within 100 days without stating your cause for doing so. This 100-day return policy excludes Tylko sample sets. Shipping is currently only available for Austria, Belgium, Bulgaria, Croatia, Czech Rep., Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, Norway and the United Kingdom.
5.1. An Order is submitted once the User: (i) determines the Product Specification and (ii) presses a clearly marked button rerouting him to the payment page. The User submits an Order by following subsequent steps within the Service. In case an Order is submitted by a User who has not concluded an Agreement, sec. 2.2 to 2.7 of these Terms shall apply during the Order and to the data provided during the Order. The Orders can only be placed for Products to be shipped to Austria, Belgium, Bulgaria, Croatia, Czech, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, Norway and the United Kingdom.
5.2. Once the Order has been placed:
a) the Provider is obligated to provide the User with a Product suitable for use, non-defective and finished in accordance with the final Specification, and
b) the User is obligated to pay the final price of the product. For all Users within the European Union, the final Product price indicated in the Service is gross (i.e. includes VAT). The final product price will be displayed in a currency accordant to the region in which The User is shopping. The Provider is not responsible for exchange rates or fees applied to the final product price and product assembly cost, should The User choose to make payment in a currency different than the indicated region-specific final price.
5.3. Before submitting an Order the User receives information on available payment methods. All payments made within the Service are processed solely by Adyen BV, a company with its registered office in Amsterdam, Simon Carmiggeltstraat 6-50, 1011 DJ Amsterdam, the Netherlands, entered into a commercial register maintained by the Kamer van Koophandel in Amsterdam under no. 34259528 (the "Broker"). During the placement of the Order, once Specification is determined and Basic Data has been provided, the User is redirected to the Broker’s website in order to select the payment method and pay for the Order.
5.4. Once the Order is submitted, the User will receive an e-mail confirming the Order’s final Specification and its acceptance by the Provider. At this point a contract for a sale of the ordered Product has been concluded between the Provider and the User (the “Purchase Agreement”) and the Order, the Specification, as well as, the Purchase Agreement itself, may not be amended.
5.5. The Provider will begin to execute the Order (i.e. initiate the Product’s production and delivery) immediately after confirmation of the User’s relevant payment is provided by the Broker. The User can track his Order using the dedicated tab in the Service.
5.6. The production process - from Users's order through to finished Product - can take up to 60 days. Once the production and packaging of the Product is complete the Product is turned over to a company providing transport, delivery or freight forwarding services (the “Deliverer”). The Deliverer delivers the Product to the User. The risk of damage to or loss of the Product is transferred upon the User once the Product has been duly delivered to the User.
5.7. Due to the fact that the Product is not prefabricated and is produced in accordance with the Specification, as per art. 38 sec. 3 of the Polish Consumer Rights Act of 30 May 2014 (Dz. U. 2014 pos. 827) (the “Consumer Rights Act”), the User may only terminate the Purchase Agreement under the terms of sec. 8 below, of which the User will be informed prior to.
5.8. In special cases caused by the specific nature of the Order, in particular, high level of individualization and complexity of the project, numerous stages of the designing and production process, the obligation to use materials meeting quality requirements, the obligation to test the products to ensure their compliance with technical requirements, the Provider reserves the right to extend the deadline set in Point 5.6 of the Regulation. The Provider will immediately inform the User of the expected new delivery time, which will constitute an amendment of the terms of the Order.
5.9. Assembly/disassembly
You can assemble most of our furniture yourself at home using the assembly instructions included in the shipment (mandatory assembly by the Tylko’s team applies to Tone cabinets). You can also use the assembly option as an additional service - before you do so, check if it is available in your country.

To assemble the furniture safely, first carefully read the assembly instructions and make sure that you have everything you need to do so and that the space on which the assembly will take place is sufficient and properly secured. Our furniture can only be assembled by competent adults. Take care to keep children and pets out of the assembly/disassembly area for their safety. To prevent any damage, protect your floor before beginning the disassembly. Wear protective boots and be especially careful if climbing a ladder. Remember that furniture elements can be heavy. Follow the directions in the assembly instructions.

Disassembly

Before taking your furniture apart, we recommend requesting a sticker set from our Customer Services to label your furniture and make reassembly much easier. You can also ask for a felt-covered protective board and/or key to be sent to you. Once the shelves are divided into sections, remember to secure them carefully for transportation. For more info, see 'How to protect elements for transport' in the Disassembly manual. Remember: Never transport a module with 'loose' verticals as they're likely to break. Additionally, be very careful with double-height verticals!

Our furniture can only be assembled by competent adults. For the safety of children and pets, keep them away from the disassembly area. To prevent damage, protect the floor before starting disassembly. Wear protective footwear and take extra care when climbing the ladder. Remember that furniture pieces can be heavy. 5.10. VAT refunds for diplomats We can apply a reduced tax rate of up to 0% to customers who have purchased products Only and at the same time prove that they are employees:
- institutions of the European Union or bodies set up by the European Union to which the Protocol on the Privileges and Immunities of the European Union applies, hereinafter referred to as 'institutions or bodies of the European Union', having their seat or central representation in the territory of a Member State other than the national territory, for the purposes of the service of those institutions or bodies; (1a) the European Commission, agencies or bodies set up by the European Union, established or represented in the territory of a Member State other than the national territory, where they acquire those goods or services in the performance of tasks entrusted to them under European Union law in order to respond to the COVID-19 pandemic;
- international organisations with a seat or representation: (a) on the territory of a Member State other than the national territory, (b) in the territory of a third country
- recognised as such by the State of headquarters and by the Republic of Poland, within the limits and under the conditions laid down by the international conventions establishing such organisations or by the agreements relating to their headquarters, for the official purposes of those organisations; (3) the armed forces of a State Party to the North Atlantic Treaty other than the Member State of destination, for the service of those forces or the civilian personnel accompanying them, or for the supply of their messes or canteens, where those forces take part in joint defence operations; (3a) the armed forces of a Member State other than the Member State of destination, for the purposes of the service of those forces or the civilian staff accompanying them or for supplying their messes or canteens when such forces take part in defence operations conducted for the purpose of carrying out an action of the European Union in the framework of the common security and defence policy;
- diplomatic missions and consular posts and members of their staff represented in the territory of a Member State other than the national territory, as well as other persons assimilated to them by laws, agreements or international customs;
- the armed forces of the United States referred to in Article 2(a) of the Agreement between the Government of the Republic of Poland and the Government of the United States of America on Enhanced Defense Cooperation, signed in Warsaw on 15 August 2020 (Journal of Laws of 2020, items 2153 and 2154), hereinafter referred to as the "Agreement on Enhanced Defence Cooperation", while on the territory of the country, if the goods or services purchased by or on behalf of those forces are intended for the exclusive official use of those forces or for the provision of their military support services referred to in Article 24 of that Agreement, if those forces take part in joint defence activities. 1a. The provisions of paragraph 1(3) and (3a) shall apply provided that the supply of goods or services is carried out with a view to a Member State of destination other than the Republic of Poland. (2) Paragraph (1) shall apply, provided that only within 7 days from the date of the customer's purchase he shall receive:
- in the case referred to in sub-paragraphs 1(1) to 1(4), the VAT or excise duty exemption certificate as referred to in Annex II to Council Implementing Regulation (EU) No 282/2011 of 15 March 2011 laying down implementing measures for Directive 2006/112/EC on the common system of value added tax (OJ L 77, 23.3.2011, p. 1, as amended), hereinafter referred to as the "certificate", completed for the purposes of taxation, for those goods and services, certified by the competent authority: (a) of the State on whose territory the entities referred to in points (1)(1) to (2) and (4) are established or represented, (b) the Member State of destination, in the case referred to in paragraph 1(3) and (3a);
- in the case referred to in subsection 1(5) - a completed VAT and excise tax exemption certificate, respectively, referred to in the Annex to the Implementing Agreement between the Government of the Republic of Poland and the Government of the United States of America to the Agreement between the Government of the Republic of Poland and the Government of the United States of America on the Status of the Armed Forces of the United States of America in the Territory of the Republic of Poland concerning Tax Exemptions for Official Purposes, signed in Warsaw on 27 April 2015. (Journal of Laws 2015, item 817 and 818), for these goods and services;
- an order relating to the goods or services (with their specifications) to which the certificate referred to in points 1 and 2 respectively relates. (3) The certificate referred to in paragraph (2)(2) shall be completed by the armed forces of the United States referred to in Article 2(a) of the Agreement on Enhanced Defense Cooperation, except that field 4 of the certificate shall be completed by the Minister of National Defense of the Republic of Poland or his authorized representative. Unused fields of the certificate shall be crossed out. (4) Completion of box 4 of the certificate referred to in paragraph (2)(2) shall not be required where the Minister of Defence of the Republic of Poland or his authorised representative issues a single certificate referred to in Article 2(2)(b) of the Agreement between the Government of the Republic of Poland and the Government of the United States of America on the Status of the Armed Forces of the United States of America on the Territory of the Republic of Poland. b of the Implementing Agreement between the Government of the Republic of Poland and the Government of the United States of America to the Agreement between the Government of the Republic of Poland and the Government of the United States of America on the Status of the Armed Forces of the United States of America on the Territory of the Republic of Poland concerning Tax Exemptions for Official Purposes, signed in Warsaw on 27 April 2015. (5) In the case referred to in paragraph 4, a copy of the single certificate shall be attached to the completed certificate and forwarded only together with the documents indicated in paragraph 2(3). (6) Where goods or services purchased by the entities referred to in paragraph 1(1), (2)(a) and (3) are intended for business purposes, the certificate need not be endorsed by the competent authorities of the State in whose territory they are established or represented or by the competent authorities of the Member State of destination. In the case referred to in paragraph 6, the operators referred to in paragraph 1(1), (2)(a) and (3)-(4) shall forward only the documents indicated in paragraph 2 and a copy of the letter, referred to in box 7 of the certificate, authorising the withdrawal of the endorsement of that certificate, issued by the competent authority of the country on whose territory they are established or represented or by the competent authority of the Member State of destination. (8) Where the goods or services purchased are used by the European Commission, an agency or a body set up by the European Union for the supply of goods against payment, the export of goods against payment, the intra-Community supply of goods against payment or the supply of services against payment, point 1a of paragraph 1 shall not apply. (9) The European Commission or any agency or body set up by the European Union shall inform only of the use of those goods or services for the supply of goods for consideration, the export of goods for consideration, the intra-Community supply of goods for consideration or the supply of services for consideration, no later than the end of the month following the month in which this supply, this export, this intra-Community supply or this supply was made, respectively.
