The Order

Summary:

In the case of configurable furniture, an Order is placed after completing the configuration process and clicking the button confirming the order with an obligation to pay. If you have an Account, you will not need to re-enter your personal data. All payments and deliveries are processed by third-party providers. Please note that we will not process your Order until payment confirmation has been received. As the majority of our products are made to order, you will not be able to amend your Order once payment has been made. With the exception of sofas, delivery is currently available to Austria, Belgium, Bulgaria, Croatia, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, Norway, and the United Kingdom. Countries and conditions for sofa delivery and assembly can be found in the Sofas section below.


5.1. An Order is placed when the User: (i) configures a piece of furniture or adds a ready-made product to their basket; and (ii) clicks the clearly marked button to place an order with an obligation to pay. The User places an Order by completing the successive steps set out within the Service. Orders for furniture and accessories — excluding sofas — are fulfilled for delivery to: Austria, Belgium, Bulgaria, Croatia, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, Norway, and the United Kingdom. Information on countries and conditions for sofa delivery and assembly, as well as sofa return conditions, can be found in the Sofas section below.

5.1.1 Speakers are available for delivery exclusively to: Germany, France, Austria, Belgium, Poland, the Netherlands, and Luxembourg.

5.2. Sofa Delivery

5.2.1. Two-Person Delivery Team — Room of Choice (Two-Man Handling)

Deliveries by two-person delivery teams are available in the following countries: Germany, the Netherlands, France, the United Kingdom, Switzerland, Austria, Belgium, Italy, Spain, Poland, Denmark, Luxembourg, Portugal, the Czech Republic, and Slovakia. This service includes delivery of the furniture to the room of the Customer's choice. Delivery charges vary depending on the region, and delivery distance and are displayed at www.tylko.com at the time of placing the Order.

5.2.2. Courier Delivery

For deliveries to Sweden, Finland, and Norway, sofas are delivered exclusively via courier to the front of the building. This means that two-man handling — i.e. carrying the furniture into the building or the designated room — is not available. The sofa is delivered on a pallet and is securely packaged to protect it during transit. Delivery charges are displayed at www.tylko.com at the time of placing the Order.

5.2.3. Sofa delivery is not available to the following countries or regions:

Italy: The Aeolian Islands (Lipari, Vulcano, Salina, Filicudi, Alicudi, Panarea, Basiluzzo, Stromboli), the Egadi Islands (Favignana, Levanzo, Marettimo, Formica), Pantelleria, the Pelagian Islands (Lampione, Lampedusa, Linosa), the Maddalena Archipelago (La Maddalena, Caprera, Budelli, Spargi, Razzoli, Santa Maria), Asinara Island, Sant'Antioco Island, San Pietro Island, Tavolara, Mal di Ventre, the Tuscan Archipelago (Elba, Giglio, Capraia, Montecristo, Pianosa, Giannutri, Gorgona), the Pontine Islands (Ponza, Palmarola, Gavi, Zannone, Ventotene, Santo Stefano), Capri, Ischia, Procida, Vivara, Nisida, Palmaria, Tino and Tinetto Islands, the Tremiti Islands (San Domino, San Nicola, Capraia, Pinosa, Cretaccio), Grado Island, Barbana Island, the Islands of the Venice Lagoon (Murano, Burano, Torcello, Giudecca, Lido di Venezia, Pellestrina), and Dino Island.

France: Belle-Île-en-Mer, Groix, Houat, Hoëdic, the Glénan Islands, the Sein Archipelago, Molène, Ouessant, Callot, Île de Batz, Île Verte, Chausey, Tatihou, Île d'Yeu, Île d'Aix, Île Madame, the Hyères Islands (Porquerolles, Port-Cros, Le Levant), the Lérins Islands (Sainte-Marguerite, Saint-Honorat), and Corsica: the Lavezzi Archipelago, the Sanguinaires Islands, and Île Cavallo.

United Kingdom: Postcodes: BT, GY, IM, JE; HS (Barra, South Uist, North Uist, Benbecula, Harris, Lewis); PA (Mull, Iona, Coll, Tiree, Jura, Islay, Colonsay, Eigg, Rum, Muck, Canna); ZE (Shetland Mainland, Unst, Yell, Fetlar, Foula, Fair Isle); KW (Orkney Mainland, Hoy, Rousay, Westray, Sanday, Papa Westray); TR (St Mary's, Tresco, St Martin's, St Agnes, Bryher); TQ (Burgh Island, Devon); NE (Farne Islands, Northumberland); SA (Skomer, Pembrokeshire; Skokholm); LL (Bardsey Island).

Germany: Sylt, Langeoog, Spiekeroog, Juist, Norderney, Borkum, Hiddensee, Pellworm, Amrum, Föhr, Hallig Hooge, Hallig Langeneß, Hallig Sylt, Neuwerk, Hallig Gröde, and Oland.

Portugal: The Azores and Madeira.

Spain: Mallorca.

The Netherlands: Vlieland, Terschelling, Ameland, Schiermonnikoog, and Texel.

Denmark: Sejerø, Fejø, Askø, Lyø, Avernakø, Læsø, and Ærø.

5.3. Prior to placing an Order, the User will be informed of the available payment methods. All payments made through the Service are processed by the following providers: Nuvei Limited, registered in Cyprus under company number HE129880, with registered office at 9 Kafkasou, Aglantzia, CY 2112, Nicosia, Cyprus; PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg; and Adyen B.V., a company registered in Amsterdam at Simon Carmiggeltstraat 6-50, 1011 DJ Amsterdam, the Netherlands, registered with the Amsterdam Chamber of Commerce (Kamer van Koophandel) under number 34259528 (each a "Payment Broker"). When placing an Order, after confirming the Specification and providing their Basic Data, the User is redirected to the Payment Broker's website in order to select a payment method and complete payment.

5.4. Following the placement of an Order, you will receive an email confirming the final Specification and our acceptance of your Order. At this point, a contract of sale for the ordered Product is entered into between Tylko and the User (the "Sales Agreement"), and the Order, the Specification, and the Sales Agreement itself shall not be subject to modification. The foregoing does not apply where an Order has been placed in breach of the promotional terms applicable at the time, as set out in these Terms.

5.5. We will commence fulfilment of the Order without undue delay following its successful verification and confirmation of payment by the Payment Broker. You may track your Order using the dedicated section within the Service.

5.6. The production process for customised furniture may take up to 60 days. Upon completion of production and packaging, the Product is handed over to a carrier, freight forwarder, or logistics service provider (the "Carrier"). The Carrier delivers the Product to the User. The risk of damage to or loss of the Product passes to the User upon its proper delivery.

5.7. As customised Products are not prefabricated and are manufactured in accordance with the Specification, pursuant to Article 38(3) of the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827) (the "Consumer Rights Act"), the right to withdraw from the Sales Agreement is available solely on the terms set out in Section 8 below.

5.8. In exceptional circumstances arising from the specific nature of an Order — in particular where the Order involves a high degree of individualisation or complexity — we reserve the right to extend the production period referred to in Section 5.6. In such cases, we will notify you without undue delay of the anticipated revised completion date, which shall constitute an amendment to the Order terms.

5.9. The majority of our furniture can be self-assembled at home using the assembly instructions included with your delivery. (Please note that Tone Wardrobes require mandatory assembly by a Tylko team.) An optional paid assembly service is also available — please check whether this service is available in your country before purchase. To assemble your furniture safely, please read the assembly instructions carefully before commencing and ensure that you have all necessary tools and that the assembly space is adequate and properly secured. Assembly must only be carried out by adults with appropriate skills and by the number of persons specified in the instructions. Children and pets must be kept safe during the assembly process. To prevent damage, please protect the floor before beginning assembly or disassembly, wear protective footwear, and exercise particular caution when using a ladder. Furniture components may be heavy. Always follow the assembly instructions.

5.10. To safely disassemble a piece of furniture, please first read the disassembly instructions carefully, available at: https://tylko.com/faq/articles/self-assembly-disassembly/how-do-i-disassemble-my-tylko. Once components have been disassembled, ensure they are adequately secured for transport. Metal components, such as drawer runners, must be properly protected. Important: Never transport components loose, as this may result in damage.

5.13. Additional Services

5.13.1. Optional Assembly Service

In selected countries, an optional assembly service may be added to your Order at the time of purchase. This service is available exclusively as an add-on at the point of ordering and cannot be purchased separately or at a later date (e.g. several months after delivery).

The assembly service charge varies depending on the country of delivery and the size of the furniture.

The assembly service includes: unpacking of the furniture (removal from packaging), assembly and placement of the furniture in the designated location, wall mounting (excluding sofas), and removal of all packaging and assembly waste.

The storage furniture assembly service is currently available in the following countries: Germany, the Netherlands, France, the United Kingdom, Switzerland, Austria, Belgium, Poland, Denmark, and Luxembourg.

The sofa assembly service is currently available in the following countries: Germany, the Netherlands, France, the United Kingdom, Switzerland, Austria, Belgium, Spain, Poland, Denmark, Luxembourg, Portugal.

5.13.2. Old Sofa Collection

In selected countries, we offer a paid collection and disposal service for old sofas, provided that the dimensions of the old sofa are comparable to those of the new sofa ordered from our store. To arrange this service, you will be required to provide the dimensions of the old sofa. We apply a reasonable approach — for example, if a three-seater sofa is ordered, we may also collect a sofa of similar dimensions.

We do not collect items that are substantially larger than the item purchased (e.g. collecting a 2-metre sofa when only an armchair has been ordered).

The old sofa collection service is currently available in the following markets only: Germany, the Netherlands, France, Austria, Belgium, and Luxembourg.

Important information and conditions:

  • This service is available exclusively as an add-on to the purchase of a new sofa and cannot be ordered separately or at a later point (e.g. several months after delivery of the Tylko sofa).
  • The service applies to sofas of the Tylko brand as well as those of other brands.
  • Collection takes place at the same location and time as delivery of the new Tylko sofa.
  • Only items of a comparable type and size will be collected (e.g. sofa for sofa, not armchair for corner sofa).
  • Free and easy access to the item to be collected must be ensured.
  • The item must be fully ready for removal. Should disassembly be required (e.g. because the item does not fit through a doorway or is too heavy), this is the responsibility of the Customer.

Circumstances in which the service team may refuse to collect an old item: (a) the item is not in a condition that allows for safe removal;

(b) the condition of the item poses a risk to the health or safety of the service team; or
	
(c) there is a discrepancy between the Order details and the actual item (e.g. the item is substantially larger than agreed).
