NOTE:
THIS CONTEST IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY OR ASSOCIATED WITH THE SOCIAL MEDIA PLATFORM ON WHICH IT IS PUBLISHED. THE ORGANISER EXEMPTS INSTAGRAM FROM LIABILITY TOWARDS PARTICIPANTS FOR THEIR PARTICIPATION IN THE CONTEST.
I. RULES FOR PARTICIPATION
- The “#mytylko Programme” Contest (“Contest”) is open to Austria, Belgium, Denmark, Finland, France, Germany, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, the Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, and the United Kingdom residents aged 18 and over. Employees, associates or board members of TYLKO S.A. with its registered office in Poland, Warsaw (00-732), ul. Czerska 8-10, KRS 0000983931, [email protected] (“Organiser”), or any of its companies, subsidiaries, affiliates, or any advertising or marketing agencies involved in this Contest (collectively, the “Contest Organising Entity”), as well as the immediate family (children, siblings, and parents) and household members of any such person, are not eligible to enter the Contest.
II. CONTEST DURATION
- The Contest is a recurring promotional programme, organised in successive editions (each, an “Edition”). The Contest runs from the launch date of its first Edition until discontinued by the Organiser (“Contest Duration”). The Organiser will announce any discontinuation of the Contest at least fourteen (14) days in advance on the Organiser’s website and/or Instagram account. Discontinuation will not affect an Edition already in progress or any rights acquired by Participants before the discontinuation.
- The start and end date of each Edition will be announced by the Organiser on the Organiser’s website and/or Instagram account prior to that Edition’s launch, together with the styling theme for that Edition. Each Edition lasts three (3) months (quarterly), starting at 00:00:01 and ending at 23:59:59 Central European Time (CET/CEST) on the announced dates. At least one (1) and no more than five (5) winners will be selected in each Edition; the total number of winners selected in a given Edition within that range will depend on the volume and quality of eligible Entries received during that Edition, as determined by the Organiser.
III. HOW TO PARTICIPATE IN THE CONTEST
- During the Contest Duration, a Participant may enter an Edition by: (1) owning a Tylko product purchased directly from the Organiser (whether by the Participant or by another person, e.g. as a gift) and being able, upon request, to provide the relevant order number; (2) publishing during that Edition a public post (a single-image post, a carousel or a Reel; Instagram Stories are not eligible) on their own Instagram profile featuring that Tylko product; (3) tagging the @tylko account in the post; (4) including the hashtag #mytylko in the post caption; and (5) following the @tylko Instagram account from the publication of the post until the winners of that Edition are confirmed (collectively, an “Entry”). By publishing an Entry tagged @tylko and marked #mytylko, the Participant confirms they have read and accept these Official Contest Rules, available on the Organiser’s website www.tylko.com, including the licence granted under Section VIII below; this notice is displayed in the Organiser’s Instagram bio and in the Organiser’s posts promoting the Contest. Only Participants who own the Tylko product shown in their Entry, and who provide the order number upon request, are eligible to be selected as winners.
- One post per person (account) per Edition is allowed. If a Participant publishes more than one Entry in the same Edition, only the first Entry published will be taken into account.
- Participation in the Contest is free of charge. The Contest is open to persons who already own a Tylko product purchased directly from the Organiser, as described in point 1 above; no additional purchase is required to enter, and making an additional purchase will not increase the chances of winning.
- To participate, you must have an account on the social media platform on which the Contest is organised. Your posts are subject to the terms of use of the respective social media platform. The use of any macros, bots, scripts, or other automated means for submissions is prohibited. Entries for the Contest will not be confirmed by the Organiser. The Participant’s Instagram account, and the Entry post, must remain public for the entire duration of the relevant Edition and until the winner is confirmed. Entries from private accounts, or accounts that are made private before the winner is confirmed, will be disqualified.
- In the event of a dispute regarding the identity of a Participant, the Entry will be deemed to have been submitted by the authorised account holder of the email address associated with the social media account used to post the Entry. “Authorised Account Holder” is a natural person who is assigned to an email address or other similar account associated with the relevant social media account. It is the user’s responsibility to provide up-to-date and correct data in order to transfer the prize, under penalty of loss.
IV. REQUIREMENTS FOR PARTICIPATION
- All Entries: (a) must be the sole original work of the participant; (b) must not be defamatory or infringe upon the publicity or privacy rights of any person, living or deceased, or otherwise infringe upon the rights of any person or entity, including but not limited to copyright, trademark, privacy or publicity; (c) must not contain any commercial/corporate advertising, including but not limited to company logos, brand names, and slogans other than those of the Organiser’s; (d) must not depict any behaviour or content that is dangerous, immoral, indecent, or otherwise inappropriate.
V. SELECTION AND ANNOUNCEMENT OF THE WINNER
- All eligible Entries will be evaluated by a jury consisting of representatives of the Organiser. The evaluation will be based on the following criteria: (i) visibility and prominence of the Tylko product in the photo or video; (ii) overall aesthetic quality of the photo or video; and (iii) how effectively the Entry reflects the styling theme announced by the Organiser for the relevant Edition. The jury will record its decision in writing.
- After each Edition has ended, the jury will select at least one (1) and no more than five (5) “Potential Winners” based on the criteria outlined above. The Potential Winner will be notified via a direct message on the social media portal where the Contest took place, in response to the post published by the Potential Winner, within 7 days of the end of the relevant Edition. The Organiser shall not be responsible for any prize notification that is lost, intercepted or not claimed by the Potential Winner for any reason not related to the Organiser. The Instagram nicknames of the winners of each Edition will be announced on the Organiser’s Instagram account after the winners have confirmed acceptance of the prize.
- The Potential Winner may be asked to complete a declaration on the acceptance of the prize (“Prize Acceptance Documents”), including the choice of prize form under Section VI, the order number for the Tylko product shown in the Entry, and the data necessary to pay the prize and settle the related income tax, i.e. first name, surname, country and address of residence and, where the prize is paid by bank transfer, the bank account details (IBAN). Winners residing outside Poland shall additionally provide, within the period referred to in point 4 below, their date of birth, full residential address and foreign tax identification number (TIN) or, if they do not have one, the number of their passport or national identity card together with the issuing country, as well as an e-mail address. These details are required for the Organiser to fulfil its obligations as tax remitter (płatnik), including the preparation of the tax information on the prize (IFT). They must be sent by e-mail to [email protected] and not via direct message on the social media portal. By providing their e-mail address, such winners agree to receive the tax information on the prize (IFT) from the Organiser electronically. Failure to provide these details within that period will be treated as failure to confirm acceptance of the prize under point 4 below.
- If the Potential Winner does not confirm acceptance of the prize and, where applicable, their choice of prize form under Section VI, to the Organiser within 10 days of the first notification attempt, or if the prize or the notification is returned as unclaimed or undelivered, the Potential Winner will be disqualified, and an alternative winner will be selected from the same Edition.
- If the Potential Winner is ineligible, fails to comply with the Official Contest Rules or refuses to accept the prize for any reason, such a Potential Winner will be disqualified and another winner may be selected.
- The jury’s decision regarding the selection of the Contest winner can be appealed by the Participant. The appeal must be sent to the [email protected] email address within 14 days of the winner being announced, and should include the Participant’s Instagram nickname, contact details and the grounds for the appeal.
- The Organiser will consider the appeal within 14 days of its receipt and inform the Participant of the outcome of the appeal by e-mail. In the event of a negative decision on the appeal, the Participant has the right to exercise the appropriate legal measures available to them in accordance with applicable national laws.
VI. PRIZES
- In each Edition, at least one (1) and no more than five (5) prizes will be awarded, one prize per winner. Each winner will receive a cash prize equal to 100% of the price paid for the Tylko product shown in their winning Entry (net of any discount applied at purchase), capped at EUR 1,500 — whichever of the two amounts is lower (the “Prize Amount”), granted as follows: (a) by default, the Prize Amount is paid to the winner by bank transfer; (b) instead of the bank transfer described in point (a), the winner may request, within the notification period referred to in Section V, a Tylko e-gift card of the same value as the Prize Amount. The prize under point (a) or (b) is a competition prize awarded for the winning Entry. It is not a refund of, or a price reduction relating to, the original purchase of the Tylko product, and no corrective invoice will be issued in connection with it. The prize is subject to the flat-rate income tax due on prizes, at the rate applicable on the date of payment (currently 10%), under Article 30(1)(2) of the Polish Personal Income Tax Act of 26 July 1991 (ustawa o podatku dochodowym od osób fizycznych). To cover that tax in full, the Organiser will grant each winner, in addition to the Prize Amount, an additional cash prize in an amount equal to the tax due on the total value of the prize (tax gross-up). The additional cash prize will not be paid out to the winner; it will be withheld by the Organiser, as the payer (płatnik), and remitted to the competent Polish tax office. The Prize Amount (paid by bank transfer or as the value of the e-gift card) is therefore the amount received by the winner net of the Polish flat-rate income tax. Any tax obligations that may arise for the winner under the laws of their country of residence remain the winner’s responsibility. If the winner does not indicate a choice within the notification period, the Prize Amount will be paid under point (a) by default. Ownership of the Tylko product shown in the winning Entry, and the price paid for it, will be verified by the Organiser in its own records by reference to the order number, to be provided by the winner upon request (also where the product was purchased by another person, e.g. as a gift). The prize may only be awarded if the order for the Tylko product shown in the winning Entry has not been cancelled and the product has not been returned, including following withdrawal from the contract. If the product is returned after the prize has been paid or the e-gift card has been issued, the Organiser may demand the return of the prize or, in the case of an e-gift card, cancel its unused balance. This does not affect any statutory rights of consumers, including the right of withdrawal. The e-gift card referred to in point (b) is a Tylko e-gift card issued by the Organiser, Tylko S.A., redeemable exclusively on www.tylko.com and otherwise subject to Tylko’s E-Gift Card Terms and Conditions (available at https://tylko.com/pl-pl/warunki-karty-podarunkowej/wstep, or the relevant country-specific version), to the extent not inconsistent with these Contest Rules. The Prize Amount is determined and paid, and the e-gift card under point (b) is issued, in the currency of the original order for the Tylko product shown in the winning Entry. Where that currency is not EUR, the EUR 1,500 cap is converted into the order currency using the average exchange rate published by Narodowy Bank Polski (NBP) (Table A) on the last business day preceding the date of the bank transfer or of the issuance of the e-gift card; for order currencies other than PLN, the cross rate is calculated from the NBP average rates of EUR and of the order currency against PLN. The e-gift card referred to in point (b) above is valid for the period set out in Tylko’s E-Gift Card Terms and Conditions for the relevant market (12 months, or 3 years for winners in Germany and Denmark), calculated from the date of its issuance to the winner rather than from a purchase date. The specific expiry date will be stated in the message delivering the e-gift card.
- The Prize Amount referred to in point (a) above will be paid by bank transfer to the bank account indicated by the winner. Any bank transfer fees will be borne by the Organiser. The bank transfer will be made in the currency of the original order, as described in point 1 above. The e-gift card referred to in point (b) above, where applicable, will be delivered by e-mail, or by direct message on the social media portal where the Contest took place, to the contact details indicated by the winner. The prize will be paid or delivered within sixty (60) days of the date on which the Organiser receives the complete Prize Acceptance Documents referred to in Section V.3, but not before the expiry of the period within which the Tylko product shown in the winning Entry may be returned under the terms of sale applicable to that order.
- Other than the one-time choice between points (a) and (b) above, to be made by the winner within the notification period referred to in Section V, the prize may not be further exchanged, exchanged for cash, or otherwise substituted, in whole or in part.
VII. CONSENT REQUIRED
- By entering the Contest, the Participant (i) agrees to be bound by these Official Rules, including all requirements relating to the conditions of participation in the Contest; and (ii) agrees to abide by the decisions of the Organiser and/or the Contest jury to the extent provided in these Rules.
- The Organiser shall not be liable, except by reason of the Organiser’s breach of duties, for: (i) lost, late, misdirected, damaged, incomplete, or illegible entries, all of which are invalid; (ii) an error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction of, unauthorised access to, or alteration of the Entry content; for technical, network, telephone, electronic, mobile device, computer, hardware or software malfunctions of any kind; or for inaccurate submission or failure to receive Entry information by the Organiser due to technical issues; (iii) any damage to the Participant’s or other person’s computer or mobile device related to or arising out of the Contest.
- If, for reasons beyond the Organiser’s control, the Contest is interrupted before the scheduled end date, e.g. due to errors or technical failures, the Organiser will, if possible, select a winner from among all those eligible at the date of interruption. For reasons beyond the control of the Organiser, including but not limited to the aforementioned circumstances, it may be necessary to amend the Contest Rules. In such a case, the Organiser will inform the Participants accordingly, in the same manner in which these Rules were made available. Amendments will not adversely affect the rights of Participants who have submitted an Entry in an Edition already in progress; with respect to such Entries, amendments apply only to the extent they are favourable to the Participants, and otherwise apply from the next Edition.
- Any attempt by a Participant to deliberately damage any website or disrupt the Contest is a breach of the law. Should such an attempt be made, the Organiser reserves the right to disqualify the Participant and claim compensation from them to the fullest extent provided by law.
VIII. PUBLICATION/USE RIGHTS
- By publishing an Entry as described in Section III, each Participant (whether or not selected as a winner) grants the Organiser a free-of-charge, non-exclusive licence to use the Entry, in whole or in part, on the Organiser’s own social media channels and website, including reposting the Entry, combining it with other content and with Entries of other Participants, and making the edits and adaptations necessary for such use (the “Basic Licence”). The Basic Licence is granted for a period of five (5) years from the publication of the Entry, without territorial limitations, and covers the following fields of exploitation (pola eksploatacji) within the meaning of Article 50 of the Polish Act of 4 February 1994 on Copyright and Related Rights (ustawa o prawie autorskim i prawach pokrewnych, consolidated text: Dz.U. 2025 poz. 24, as amended): (i) recording and reproduction by any technique, including digital reproduction; (ii) entry into computer memory and computer/ICT networks, including the Internet; (iii) making the Entry available to the public in such a way that members of the public may access it from a place and at a time individually chosen by them; and (iv) dissemination via the Organiser’s own social media channels and website. Within the scope of the Basic Licence, the Participant authorises the Organiser to prepare derivative works (opracowania) based on the Entry and to exercise the rights to such derivative works (prawa zależne). The Organiser may entrust the exercise of the Basic Licence to its contractors (e.g. creative agencies) acting on its behalf. Where technically feasible, the Organiser will indicate the Participant’s Instagram nickname when using the Entry. The use of an Entry in the Organiser’s paid advertising campaigns (including paid social media advertising) or in the Organiser’s email/newsletter communications requires a separate licence and, where the Entry depicts the Participant, the Participant’s separate consent to the use of their image, which the Organiser will request from the Participant (e.g. by direct message) before any such use, specifying the scope and duration of such use (the “Extended Licence”). Granting the Extended Licence is voluntary and is not a condition of participating in the Contest or of receiving a prize. The licences described in this Section cover only the Participant’s own contribution to the Entry. The Organiser will not use, outside the Instagram platform, any music or other third-party content included in the Entry (e.g. from Instagram’s music library), unless it has obtained the necessary rights.
- The Participant agrees that the Organiser may publish their Instagram nickname and profile picture in connection with announcing the winners and with reposting the Entry under the Basic Licence. Any other use of the Participant’s image, in particular in paid advertising, requires the Participant’s separate consent under point 1 above. If the Entry depicts any third party, the Participant represents and warrants that they have obtained all necessary consents from such third party, including consent to the use of their image in accordance with this Section, prior to submitting the Entry, and shall indemnify the Organiser against any claims arising from the absence of such consent.
IX. PERSONAL DATA
- The Organiser processes Participants’ personal data in connection with the Contest as described in the Privacy Policy in Section XII below.
- Entries are published by Participants on their public Instagram profiles and are therefore visible to the public.
X. APPLICABLE LAW
- The Participant agrees that, in the event of any dispute, amicable resolution will be sought as the initial solution.
- These Rules and the Contest are governed by Polish law. This choice of law does not deprive a Participant who is a consumer of the protection afforded to them by the mandatory provisions of the law of the country of their habitual residence. A Participant who is a consumer may in any case bring proceedings before the courts of the country of their residence.

- If you decide to participate in the “#mytylko Programme” contest (“Contest”), please read the following information on the processing of your personal data.
- In connection with the Contest, we process: your login/nickname, profile picture and the content of your Entry on the platform we use to run the Contest (all Participants); and, only from Potential Winners and winners: first name and surname, e-mail address, order number, country and address of residence, bank account number (IBAN) where the prize is paid by bank transfer, and, for winners residing outside Poland, date of birth and foreign tax identification number (TIN) or passport or national identity card number together with the issuing country. If you do not want Tylko to process your personal data, do not participate in the Contest. Whenever you share your personal information, we make sure it's processed in accordance with applicable laws and to the highest standards of care and safety. The legal basis is Article 6 (1) b) of the GDPR; to the extent necessary to comply with the Organiser’s tax and accounting obligations (in particular in relation to the prize, the flat-rate income tax and the tax information on the prize (IFT)), Article 6(1)(c) GDPR; and, for handling appeals and for the establishment, exercise or defence of legal claims, the Organiser’s legitimate interest (Article 6(1)(f) GDPR). We store personal data for the duration of the relevant Edition and, after that, for the period required by law: data relating to the prize and its taxation for five (5) years from the end of the calendar year in which the tax payment deadline expired, and data necessary to handle appeals and claims until the expiry of the applicable limitation periods; the nickname and Entry of a Participant whose Entry is used under Section VIII are stored for the duration of the relevant licence. Where the Organiser uses an Entry beyond what is necessary to administer the Contest (in particular in paid advertising and email/newsletter communications, as described in Section VIII), this additional processing is based on the Participant’s separate, specific consent (Article 6(1)(a) GDPR), obtained before such use.
- The entity responsible for processing your personal data – the data controller - is Tylko S.A. with its registered seat at 8/10 Czerska Street, 00-732 Warsaw, Poland (“Tylko”/“Controller”). Tylko processes your personal data in compliance with the provisions of the Regulation (EU) 2016/679 of the European Parliament, of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the “GDPR”).
- The Controller can be contacted via [email protected]. You can contact the Controller on all matters relating to the processing of personal data and the use of data processing rights. Your personal data is processed to participate in the Contest. If you are selected as a winner, or if the Organiser otherwise wishes to use your Entry beyond administering the Contest, your Entry (including any image depicting you) may also be used in the Organiser’s paid advertising campaigns and in email/newsletter communications. This additional processing is based on your separate, freely given consent (Article 6(1)(a) GDPR). The Organiser will ask you to confirm this consent separately (e.g. by direct message) before any such use. This consent is not a condition of receiving the prize, and you may refuse or withdraw it at any time without affecting your entitlement to the prize. We may need to share your personal data with third parties to do this, such as our contractors (e.g. creative agencies), banks and online payment providers. The Contest is run on Instagram, operated by Meta Platforms Ireland Ltd, which processes your data in accordance with its own terms and privacy policy. Where possible, we'll provide you with information on the processing of your personal data received from a third party. In some instances, we may also be required to share your personal data with public authorities upon their substantiated, specific request. Winners’ data will also be provided to the competent Polish tax authorities to the extent required by tax law.
- We use strict technical and organisational measures to secure all personal data that is processed by us from loss, destruction or unauthorised access by third parties. We cannot, however, take responsibility for any unauthorized access to your personal data caused by security breaches that might happen in relation to your device, browser or your own negligence.
- You have the right to access your data, the right to demand its rectification, removal or restriction of its processing and the right to data portability. At your request, the Controller will provide a copy of the personal data to be processed, but for any subsequent copies you request, the Controller may charge a reasonable amount resulting from administrative costs. You have the right to object to the processing of your personal data. You have the right to withdraw your consent at any time. Withdrawal of the consent does not affect the lawfulness of the processing that was made on the basis of the consent before its withdrawal. To the extent that your data is processed in an automated way to perform and conclude the contract, or processed on the basis of consent, you also have the right to transfer personal data (such as to receive personal data from the Controller) in a structured, commonly used machine-readable format. You may send this data to another data Controller. You also have the right to lodge a complaint with the supervisory authority dealing with the protection of personal data (in Poland: the President of the Personal Data Protection Office, Prezes Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warsaw) or with the supervisory authority of your country of residence. In order to exercise the above rights, please contact the data Controller.
