You may access tylko.com via a web browser. The Service is free of charge; however, payment is required for any products ordered.

1.1. These Terms of Service ("Terms") govern the conditions of use of the website and online store, together with all functionalities available at www.tylko.com, including in particular the product review system, contact forms, and all other areas of the Service that enable users to publish content (the "Service").

1.2. The Service is operated by Tylko S.A., with its registered office in Warsaw, ul. Czerska 8/10, 00-732 Warsaw, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under KRS number 0000536581, VAT number (NIP): 1132882374, email address: [email protected], telephone number: +44 800 102 6747 (the "Seller" or "Tylko"). The Service presents products and information relating to the Seller's offer and business activities, including content of a promotional or marketing nature pertaining exclusively to Tylko S.A., unless expressly stated otherwise. Tylko clearly identifies all advertising or marketing content in a manner that enables Users to recognise its promotional nature, in particular through appropriate placement within the Service or by means of corresponding labels (e.g. "offer", "promotion"). Tylko does not sell advertising space within the Service to third parties and does not, as a general rule, publish third-party advertisements.

1.3. Tylko provides every user of the Service ("User") with access to the Service, and in particular to those elements of the Service that enable the following:

(a) the selection of a ready-made product or the configuration of customised furniture — including the specification of parameters such as height, width, depth, colour, and material (hereinafter the "Specification") — from the range of furniture offered by Tylko (a "Product");
	
(b) the visualisation of a Product in augmented reality, rendered in accordance with the Specification;
	
(c) the placing of an order for a Product in accordance with the Specification, including its manufacture and delivery by Tylko (an "Order");
	
(d) the management of a User account within the Service (an "Account");
	
(e) the browsing of the Service and of Content published therein, meaning information published within the Service by a User or on a User's behalf, including in particular product reviews, comments, product ratings, and descriptions of purchasing experiences; 
	
(f) the publication within the Service by Users, or on their behalf, of information including in particular product reviews, comments, descriptions of purchasing experiences, ratings, and photographs ("Content").

The above are referred to collectively as the "Services".

1.4. The Services are provided free of charge. The User shall, however, bear all costs associated with the fulfilment of an Order, including the price of the Product, delivery charges, and, where applicable, the cost of assembly, should the User elect to include that option.

1.5. For the purposes of fulfilling the Seller's obligations in respect of reporting the average number of active recipients of the service under the Digital Services Act (DSA), the Seller defines an "Active Recipient of the Service" within the meaning of Article 24(2) of the DSA as a unique user located within the territory of the European Union who, in a given month, accessed tylko.com or any of its subpages and may therefore have been exposed to information presented on the Service, including content generated or published by other users (such as product reviews). The number of active recipients is determined on the basis of unique user identifiers (user accounts or equivalent technical identifiers), applying reasonable and proportionate methods to avoid counting the same user more than once. For the purposes of calculating the number of active recipients, internal traffic (including employees and test environments), automated traffic (in particular bots and web crawlers), and users whose interactions took place exclusively outside the territory of the European Union are excluded. The published figure represents the monthly average number of active recipients over the six-month period preceding publication, in accordance with Article 24(2) of the DSA and the guidelines of the European Commission on calculating the average monthly active recipients of services.
